PREAMBLE

These General Terms and Conditions of Sale (hereinafter the “Terms C Conditions”) govern the contractual relationship between any non-professional user (hereinafter the “Guest”) and Palais Ségurane Boutique Hôtel (hereinafter the “Hotel”), as well as the use of the website accessible at www.palaissegurane.com (hereinafter the “Website”), operated by PALAIS SEGURANE, a simplified joint-stock company (SAS) registered under number 905 329 314 00017, whose registered office is located at 7 Rue de la Préfecture, 06300 Nice, France, VAT number FR79905329314.

These Terms C Conditions apply to all hotel reservations made through the Website, from booking confirmation until the Guest’s departure.

1.Acceptance of the Terms s Conditions

Any reservation implies full and unconditional acceptance of these Terms C Conditions. The Guest acknowledges having read them before confirming the reservation. Acceptance is formalised online by ticking the mandatory validation box. The Guest may download, save or print these Terms C Conditions.

2.Modification of the Terms s Conditions

The Hotel reserves the right to modify these Terms C Conditions at any time. The applicable version is the one in force at the time of booking confirmation.

SCOPE OF APPLICATION

These Terms C Conditions apply to all hotel reservations made:

  • directly with the Hotel by telephone, email or onsite;
  • or online via the booking system available on the Website.

The booking confirmation sent to the Guest constitutes proof of the transaction and full acceptance of these Terms C Conditions.

CAPACITY

The Guest declares that the reservation is made for personal purposes only and confirms having the legal capacity to enter into this agreement. The Guest is solely responsible for the accuracy of all information provided. Any fraudulent use of the booking services may result in refusal of access to the Hotel and possible legal action.

FORMATION OF THE CONTRACT

The reservation contract is considered valid once a booking number has been assigned and communicated to the Guest. The confirmation summarises the essential booking details and constitutes a firm contractual commitment.

SELECTION OF SERVICES

The Guest selects the services offered on the Website according to their own needs and responsibility. The Guest acknowledges having reviewed all relevant information before booking.

BOOKING PROCEDURES

Reservations may be made:

A written confirmation will be sent as soon as possible. Minors must always be accompanied by an adult.

PROOF OF TRANSACTION

Electronic records stored by the Hotel constitute valid legal proof of reservations and transactions.

PRICES

Prices are clearly displayed before booking confirmation. Rates are expressed in euros, VAT included. City tax is payable directly at the Hotel unless otherwise stated. Two rate types may apply:

  • Preferential rate: non-refundable and non-modifiable;
  • Flexible rate: modifiable and refundable under applicable conditions.

The Hotel reserves the right to modify prices at any time without affecting confirmed bookings.

PAYMENT TERMS

Bank guarantee

A valid bank card is required to guarantee the reservation. The Hotel may request proof of identity.

Preferential rates

Non-refundable rates are fully prepaid at the time of booking. The reservation becomes final only after payment authorisation.

Flexible rates

No payment is charged at the time of booking. The bank card serves solely as a guarantee. Payment is due directly at the Hotel.

Extras

Additional expenses (minibar, restaurant, services, etc.) are payable onsite. The Guest authorises the Hotel to charge the provided card if necessary.

Pre-authorisations

A €1 pre-authorisation may be carried out to verify the validity of the card. Fourteen days before arrival, an additional pre-authorisation corresponding to the first night may be processed.

MODIFICATION OF THE RESERVATION

Preferential rates cannot be modified. Flexible reservations may be modified subject to availability and possible rate adjustments. No modification is valid without written confirmation.

In case of force majeure or exceptional unavailability, the Hotel may offer accommodation in an equivalent or superior establishment at no additional cost.

CANCELLATION POLICY

In accordance with Article L.121-20-4 of the French Consumer Code, no withdrawal right applies. Non-refundable reservations cannot be cancelled. Flexible reservations may be cancelled according to the applicable cancellation policy. Cancellation requests must be sent by email or completed through the cancellation link provided in the booking confirmation.

  • For stays of 1 to 3 nights: Cancellation less than 3 days before arrival: 100% of the stay charged.
  • For stays longer than 3 nights: Cancellation less than 5 days before arrival: 100% of the stay charged.

GROUP CONDITIONS

Reservations of more than three rooms are considered group bookings. Special conditions apply.

Payment conditions

30% deposit upon confirmation. Balance payable 20 days before arrival.

Cancellation conditions

Specific cancellation penalties apply depending on the notice period.

STAY CONDITIONS

Reception is open 24/7. Rooms are available from 3:00 PM and must be vacated by 12:00 PM. Late departure may incur additional charges.

Guests must respect the Hotel, other guests, hygiene, safety and public order. Any inappropriate behaviour may result in immediate expulsion without refund.

DAMAGE

Any damage caused by the Guest will be charged accordingly. Smoking penalties may apply.

USE OF DIGITAL SERVICES

The Guest undertakes to use the Wi-Fi and digital services legally and responsibly.

GUEST RESPONSIBILITY

The Guest is responsible for the accuracy of the information provided and for any use of their account. Any fraudulent reservation or payment will result in automatic cancellation.

HOTEL LIABILITY

The Hotel is bound by an obligation of means regarding online booking services. The Hotel shall not be liable for Internet-related issues, viruses, interruptions or third-party websites. Photos and visuals are non-contractual.

PERSONAL DATA

Personal data are collected for reservation management, payments, customer service and marketing purposes. Data are processed in compliance with GDPR regulations. Guests have the right to access, rectify or oppose the processing of their data.

COOKIES

The Website uses cookies to improve browsing and personalise services. Guests may disable cookies in their browser settings.

INTELLECTUAL PROPERTY

All Website content is protected by intellectual property laws. Any reproduction or use without prior written authorisation is prohibited.

ENTIRE AGREEMENT

These Terms C Conditions and the booking confirmation constitute the entire agreement between the parties.

FORCE MAJEURE

Neither party shall be held liable in the event of force majeure as defined by French law.

COMPLAINTS

Complaints must be sent by registered mail within 15 days after departure.

GOVERNING LAW s JURISDICTION

These Terms C Conditions are governed by French law. In the event of a dispute, the Guest may contact the Tourism and Travel Mediator: MTV Médiation Tourisme Voyage – www.mtv.travel

PRE-CONTRACTUAL INFORMATION

The Guest acknowledges having received all mandatory pre-contractual information before confirming the reservation.
